High-profile residential property defective works case settles

Damien Keogh, partner and head of the Construction Group at Matheson Ormsby Prentice advised film director, Jim Sheridan and his wife Fran who claimed they faced serious water ingress problems due to alleged defective works to “Martha’s Vineyard”, Coliemore Road, Dalkey, Co. Dublin.
They sought some €4 million against a number of companies involved in the project, alleging the works have resulted in water ingressing into their home over a number of years. The €4 million claim was in respect of the cost of repairing the property and to compensate the Sheridans for the loss of opportunity to sell the house at the height of the property market.
The case was due to open on Tuesday 5 October 2010 but talks began and the Sheridans reached a settlement that they were delighted with on Wednesday 6 October 2010.
