  • Commencement of New Planning Legislation
  • The Planning and Development (Amendment) Act 2010 was signed into law on 26 July. The Minister for the Environment, Heritage and Local Government has commenced various provisions of the Act with effect from 19 August 2010. Most of the other provisions of the Act are commenced with effect from 28 September 2010. The remaining sections will be commenced at a later date.

  • The Criminal Justice (Money Laundering and Terrorist Financing) Act 2010 provides for authorisation and registration procedures for persons carrying on the business of specified trust and company services providers which are not already regulated as members of a designated body or otherwise accepted.

  • The Minister for Justice and Law Reform has made an Order commencing all provisions of the Criminal Justice (Money Laundering and Terrorist Financing) Act 2010 with effect from 15 July 2010.

  • Irish Data Protection Commissioner approves personal data security breach code of practice
  • On 7 July 2010 the Irish Data Protection Commissioner (“DPC”) formally approved a “Personal Data Security Breach Code of Practice” (the “Approved Code”). Previously the DPC had on 31 May 2010 published a draft “Security Breach Code of Practice” (“the Draft Code”) on which the DPC had invited comments and observations from the public by Friday 18 June 2010.

  • Central Bank and Supervision of Banks
  • The Central Bank has published a detailed Strategy Report on "Banking Supervision – Banking Supervision; Our New Approach". The Report outlines a new approach to regulation of retail, wholesale and international banks in Ireland. The Report proposes a more intrusive and challenging approach to banking supervision with substantially more follow-through by supervisory staff.

  • The Minister for Communications, Energy and Natural Resources has published Regulations (European Communities (Audiovisual Media Services) Regulations 2010) to transpose the provisions of the Audiovisual Media Services Directive (2007/65/EC).

  • The Minister for Enterprise Trade and Innovation has published Regulations to give effect to Directive 2006/43/EC on Statutory Audits of Annual Accounts and Consolidated Accounts.

  • Anti Money Laundering Legislation Enacted
  • The Criminal Justice (Money Laundering and Terrorist Financing) Act 2010 was signed into law on 5 May. The Act will now require the making of the necessary Commencement Orders by the Minister for Justice and Law Reform.
